SALES GENERAL CONDITIONS, INFORMATION AND NOTES

  1. ORDERS :
    1.1 When a order is placed by the Customer, it is implicit the observance and the acceptance of all below mentioned Sales General Conditions.
  2. DELIVERY TIME :
    2.1 As delivery day, it is intended the one in which goods are shipped or, anyhow, told as ready for the shipment. Partial shipments are admitted.
    2.2 It is our principle to do our best to keep the delivery date promised but this fact does not constitute from our side an absolute commitment about shipping time and a possible delay is not giving the right to the Customer neither to cancel or reduce the order nor to commence any action or redraft for damages.
  3. SHIPMENT:
    3.1 Goods always travel at Customer’s risk even if they are sold free delivered and our Firm cannot be held responsible for damages occurred during the transport. Possible requests for insurance covering are at Customer’s charge.
    3.2 When Customer collects goods personally at our warehouse, Customer is obliged to verify quantities and weights, as indicated on our delivery papers (delivery note or invoice). AEP does not accept complaints after 8 (eight) days from goods receiving.
  4. WARRANTY :
    4.1 Warranty becomes effective from the purchase date. The term of warranty is according to law. Warranty looses in case of : tampering of any type; use incorrect or, anyhow, not corresponding to the specifications given by AEP;  unreadability of the label showing the serial (or lot) number when present; product non identifiable as manufactured by AEP. AEP does not assume any responsibility for damages at things and/or people, eventually caused by the product if not duly used.
    Intervention and/or repairing on the premises are not provided.
    4.2 Our warranty commitment of supplied equipment good functioning involves a free repairing or free replacement in the shortest possible time of those parts which could be damaged because of a construction defect or a material defect during the warranty period, with the tacit unacceptability of any request of compensation either for damages or for other expenses.
    All the repairing, under warranty and not, are going to be performed exclusively at our laboratory
    4.3 All transport costs, there and back, related to goods to be repaired, are always at Customer’s charge.
  5. PLACE OF JURISDICTION :
    5.1 For any dispute, the place of jurisdiction is Modena.
  6. VALIDITY :
    6.1 The offer has a validity of 90 (ninety) days form its issue date.
  7. PRIVACY :
    7.1 Pursuant to the law n.196 / 2003 on the protection of privacy, we inform you that based on the commercial relationships established we hold the personal and fiscal data relating to you strictly necessary for all legal obligations. In compliance with current legislation, these data may be disclosed to: external subjects who perform specific tasks on behalf of the company (accountants, law firms ..), credit institutions for the financial management of the contracts entered into, Public Administrations to fulfill legislative obligations current

 

SPECIFIC CONDITIONS FOR ALL CALIBRATION SERVICES

In addition to AEP general sales conditions, for the LAT 093 Laboratory it is hereby specified that:

 

1) The Laboratory is accredited by ACCREDIA according to the UNI CEI EN ISO/IEC 17025 norm.

This ensures the laboratory’s competence, independence and impartiality of the calibrations performed.

ACCREDIA is a signatory of the EA-MLA and ILAC-MRA international agreements.

 

2) All activities covered by the accreditation are contractually managed by the LAT 093 Laboratory as accredited unless otherwise specified by the Customer.

This request must be clearly indicated in the contractual agreement.

All possible calibration services are shown in the Accreditation chart that can be consulted on ACCREDIA’s internet webpage.

 

3) The LAT 093 Laboratory performs calibrations exclusively with the procedures set by ACCREDIA.

 

4) The LAT 093 Laboratory does not give opinion nor interpretation.

 

5) The LAT 093 Laboratory can, in the Calibration Certificate, specific recommendations concerning the calibration interval only upon customer’s request.

The laboratory is not responsible for the usage of such recommendations.

 

6) Customer can ask LAT 093 Laboratory for a CONFORMITY DECLARATION solely in writing.

This request must contain the specifics and the decision rule or the risk level from which the rule can be derived.

In case the Customer asks for a conformity declaration without indicating the decision-making rule, the Laboratory will elaborate the declaration according to the “default” case as per the norm UNI EN ISO 14253– 1.

 

7) THE TIME OF DELIVERY IS 10 BUSINESS DAY from the receipt of the order and the measuring instruments, unless otherwise specified.

 

8) The instruments sent, especially the electronical ones, must be shipped along with their corresponding USER GUIDE.

 

9) Should there be no SERIAL NUMBER marked upon the instruments, the laboratory is authorized to print one upon it so that it can be referred to in the certificate.

 

10) In case a malfunction is found on the instruments sent for calibration, and this is not due to the Laboratory, it may be asked the Customer to PAY A REFUND for the usage of the Laboratory’s equipment as follows:

129 € Net/Each for dynamometer, load cell and torque meters.

51 € Net/Each for pressure gauges and torque wrenches.

 

11) The instruments MUST be sent to the laboratory with only those ACCESSORIES that are necessary for the calibration.

These will have to be agreed upon with the Laboratory while evaluating the calibration Offer.

 

12) The instruments MUST be entirely and externally CLEAN.

In addition, any process fluid (oil, fuel, grease, etc…) must be removed from the pressure gauges, analog manometers, pressure transmitters or transducers.

 

13) Unless otherwise specified by the customer, in the accredited calibration, the correction of the reading error is always performed FREE of charge if a user guide or instruction is provided.

 

14) The ORIGINAL ACCREDIA certificate with the digital signature in its electronic format is sent by email. Customers must always state in their orders the email address to whom the certificate has to be sent.

 

15) If the certificate is to be INTESTED out in the name of a different addressee, all data concerning the different addressee must also be clearly indicated in the order.

 

16) The TRANSPORT is always the responsibility of the Customer.

Should the instruments arrive at the Laboratory with a damaged or unsuitable PACKAGE, the Laboratory has the right to replace it with an adequate one in order to preserve the metrological characteristic of the instruments.

Customers will be promptly informed about the additional costs.
